S.O.C. Catering UG (limited liability)

1. Scope of Application

These General Terms and Conditions apply to all services and deliveries provided by S.O.C. Catering UG (limited liability) (hereinafter referred to as the “Caterer”) in connection with catering, event, and food service operations.

Any deviating or supplementary terms of the client shall only become part of the contract if expressly confirmed in writing by the Caterer.

3. Conclusion of Contract

A contract shall be deemed concluded upon:

  • written acceptance of the quotation by the client

  • written order confirmation by the Caterer

  • or the execution of the agreed services

All quotations are subject to change and non-binding unless expressly stated otherwise.

4. Scope of Services

The scope of services shall be determined by the respective quotation or order confirmation.

The Caterer reserves the right to substitute individual items with equivalent alternatives in the event of unavailability.

Any amendments or additions to agreed services must be confirmed in writing.

5. Minimum Order Quantity

Catering services are generally offered for a minimum of 15 persons, unless otherwise agreed.

6. Number of Participants

The final number of participants must be communicated to the Caterer no later than 7 days prior to the event.

This number shall form the basis for invoicing.

Any short-notice increase in participant numbers will be charged additionally based on actual costs incurred.

7. Prices

Unless otherwise stated, all prices are exclusive of statutory VAT.

Pricing may vary depending on, in particular:

  • number of participants

  • duration of the event

  • event location

  • scope of services

  • additional services requested

Individual quotations may differ from standard pricing.

8. Payment Terms

For events, the following payment terms shall generally apply:

  • 50% deposit upon booking or no later than 14 days prior to the event

  • remaining balance payable after completion of the event

Unless otherwise agreed, payment is due within 7 days of invoice issuance.

Accepted payment methods include:

  • bank transfer / invoice

  • card payment

  • cash payment

Different payment terms may be agreed for public sector or institutional clients.

9. Cancellation

Cancellations must be made in writing.

The following cancellation terms apply:

  • up to 14 days prior to the event: free of charge

  • up to 7 days prior to the event: 50% of the agreed services

  • less than 7 days prior to the event: 100% of the agreed services

Costs already incurred or special orders may be charged additionally.

10. Event Location and Organisation

The organiser is generally responsible for the organisation of the event.

Unless otherwise agreed:

  • setup and dismantling within the event premises shall be the responsibility of the organiser

  • all necessary permits must be obtained by the organiser

Deliveries to alternative buildings or venues may incur additional charges.

11. Delivery

Deliveries may be made to alternative buildings or event locations.

Additional delivery charges may apply depending on distance, effort, and logistical requirements.

12. Equipment and Rental Items

All items provided by the Caterer (e.g. crockery, glassware, cutlery, equipment, or decoration) remain the property of the Caterer.

The client shall be liable for:

  • loss

  • damage

  • improper use

Missing or damaged items will be charged at replacement value.

13. Food and Liability

The Caterer assumes no liability for food taken away by the client or guests after the event.

Upon handover, responsibility for storage and consumption lies with the client.

14. Liability

The Caterer shall only be liable for damages resulting from intentional misconduct or gross negligence.

No liability shall be accepted for indirect damages, consequential losses, or loss of profit.

Liability for personal injury remains unaffected.

15. Force Majeure

In the event of force majeure (e.g. natural disasters, official orders, strikes), the Caterer shall be entitled to withdraw from the contract.

Services already rendered must be paid for accordingly.

16. Data Protection

Personal data will be processed exclusively for the purpose of performing the contractual relationship.

17. Jurisdiction and Governing Law

To the extent permitted by law, the place of jurisdiction shall be the registered office of S.O.C. Catering UG (limited liability).

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Germany.
